Terms & Conditions – Clear Code Diagnostics

By booking any service with Clear Code Diagnostics (“we”, “us”, “our”), you (“the customer”) confirm that you have read, understood, and agreed to the following Terms & Conditions. Acceptance is automatic upon booking.

1. Booking Disclaimer
• All bookings are subject to availability and confirmation.
• The minimum call-out fee is the cost of the service booked and is non-refundable. This covers travel, time, equipment use, and professional expertise.
• Booking a service does not guarantee that a fault will be found, repaired, or resolved.
• It is the customer’s responsibility to provide accurate vehicle details, location, and access at the time of booking.
• We reserve the right to refuse or stop work if conditions are unsafe or unsuitable.

2. Service Disclaimer
• All services provided are diagnostic and advisory only, unless explicitly stated otherwise.
• We do not carry out MOT testing, full servicing, or major mechanical repairs.
• Any advice or reports provided are based solely on the vehicle’s condition at the time of inspection.
• Diagnostic results may be limited by:
• Manufacturer or dealer-only software restrictions
• Locked or restricted control modules
• Intermittent or non-reproducible faults
• Vehicle condition or prior repairs
• Some limitations may only become apparent once diagnostic equipment is connected.
• No guarantee is given that a fault code, cause, or repair solution will be identified.
• Referrals to third-party garages are recommendations only. We accept no responsibility for their work, pricing, or warranties.

3. Payment Disclaimer
• Full payment is due upon completion of the visit, regardless of outcome.
• Deposits for parts or consumables are non-refundable once ordered.
• Accepted payment methods include card, bank transfer, or cash.
• Prices may be updated at any time without prior notice.
• Mileage charges apply beyond 8 miles at £1.20 per mile, with a maximum operating radius of 40 miles.

4. Vehicle Condition & Access
We are not responsible for incomplete or failed diagnostics caused by:
• Low or flat battery voltage
• Immobilisers or security restrictions
• Aftermarket modifications or wiring faults
• Corrosion, water ingress, or previous repair damage
If battery voltage is insufficient to carry out testing, charging or replacement may be recommended at additional cost.

5. Cancellations & Missed Appointments
• Appointments cancelled with less than 24 hours’ notice may be charged in full.
• No-shows or lack of access to the vehicle will be charged in full.
• If work cannot proceed due to unsafe conditions, poor access, or customer unavailability, the call-out fee remains payable.

6. Safety & Working Conditions
• Customers must provide a safe, legal, and suitable working area.
• Work will not be carried out on unsafe ground, steep slopes, or in dangerous environments.
Fluid Level Disclaimer
Vehicles must be parked on level ground for accurate fluid readings.
If parked on a slope or uneven surface:
• Readings may be inaccurate
• We may request the vehicle be moved (with permission)
• We may refuse to report fluid levels if conditions are unsuitable
We accept no liability for inaccurate readings caused by parking conditions.

7. Limitation of Liability
• We are not liable for future faults, breakdowns, recovery costs, loss of earnings, missed appointments, or inconvenience.
• We are not responsible for decisions made by customers or third parties based on our findings or reports.
• Our total liability for any claim is strictly limited to the value of the service provided.

8. Insurance & Legal
• Clear Code Diagnostics holds appropriate public liability insurance.
• Customers remain responsible for ensuring their vehicle is road legal, insured, taxed, and MOT compliant.
• These Terms & Conditions are governed by the laws of England and Wales.

9. Acceptance
By booking a service, the customer confirms acceptance of these Terms & Conditions in full.

10. Force Majeure
Clear Code Diagnostics shall not be held liable for any delay, cancellation, failure to attend, or inability to provide services due to events beyond our reasonable control. This includes, but is not limited to:
• Severe weather conditions
• Road closures, traffic accidents, or breakdowns
• Vehicle failure or equipment malfunction
• Illness or injury
• Power, network, or system outages
• Acts of God, fire, flood, or natural disasters
• Government restrictions or emergency situations
In such circumstances, we reserve the right to reschedule the appointment or cancel the booking without liability. Where possible, we will make reasonable efforts to notify the customer as soon as practicable. No compensation or refunds shall be due for delays or cancellations caused by force majeure events.
